Crime No.17 of 2017 ..Respondent(s) PRAYER: Criminal Miscellaneous Petition is filed under 482 of Cr.P.C. r/w 528 of BNSS, seeking to Clarify and / or modify the order dated 13.02.2024 passed in Criminal Appeal No.694 of 2018 against Spl.S.C.No.42 of 2017, to resolve the inconsistency between paragraph 1 (directing that the sentences shall run concurrently) and paragraph 37, Point-II, (confirming the Trial Court judgment directing that the sentences shall run consecutively), declare that the sentences imposed in the three convictions shall run concurrently in accordance with the observation contained in paragraph 1 of the appellate Court judgment and in exercise of the powers under section 528 of BNSS, or pass such appropriate directions treating the sentences to run concurrently. ORDER

Learned counsel for the petitioner / appellant would submit that in paragraph No.46 of the order passed by the Magalir Neethimandram, Fast Track Mahila Court, Tiruppur, dated 17.10.2028, the charges were stood against the accused proved and he was convicted and sentenced to undergo Rigorous Imprisonment for seven (7) years with a fine of Rs.20,000/- for each __________ https://www.mhc.tn.gov.in/judis

kas offence (3 counts). He would further state that the above sentences are to run concurrently.

2.In light of the above, Paragraph No.37 (ii) of the order of this Court dated 13.02.2024, it is to be read that the sentences are to run concurrently. To this effect, this Criminal Miscellaneous Petition stands ordered. 3.Registry is directed to make necessary correction in the order passed by this Court on 13.02.2024 and issue a corrected copy to the parties concerned.
