Writ Petition filed under Article 226 of the Constitution of India, seeking issuance of a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned order issued by the 2nd respondent vide Proceedings Na.Ka.En.A3/e-5513314/2023, dated 12.10.2023 and to quash the same as illegal and violation of Article 14, 19, 21 of the constitution of India and Consequently direct the respondents to appoint the petitioner in any of the suitable post to which the petitioner eligible on compassionate grounds by applying the Principles of parity.

ORDER
This Writ Petition has been filed seeking quashment of the impugned order passed by the second respondent dated 12.10.2023, and a direction to the respondents to appoint her to a suitable post on compassionate grounds.
2. Mr.T.M.Rajangam, learned Government Advocate takes notice on behalf of the respondents. In view of the consent expressed by the learned counsel on either side, the Writ Petition is taken up for final disposal at the stage
of admission itself.
3. The case of the petitioner is that the her mother served as a First Grade Police Constable and died in harness on 20.08.2016. Thereafter, the petitioner made a representation dated 30.05.2019 before the second respondent, seeking appointment on compassionate grounds. The said representation was rejected on the ground that the petitioner had not attained majority. Subsequently, upon attaining the age of majority, submitted another representation dated 29.08.2023 before the second respondent, seeking compassionate appointment. The same was rejected on the ground that the application was not made within three years from the date of death of her mother and that petitioner had not completed 18 years within the prescribed three year period, as required under G.O.(Ms).No.18 dated 23.01.2020. Challenging the said order, the petitioner has filed this Writ Petition.
4. Learned counsel for the petitioner contended that the petitioner lost both her parents at a young age and was only 12 years old at the time of her mother's demise. The learned counsel submitted that the petitioner's earlier application was rejected solely on the ground of minority and after attaining majority, she promptly submitted a fresh representation, which was rejected on two grounds that she had submitted her representation after a lapse of three years from the date of her mother's demise and that she was only aged 15 years
6 months and 16 days on the date of completion of three years from the date of her mother's demise, in accordance with G.O.(Ms).No.18, Labour and Employment Department (Q1), dated 23.01.2020. as per G.O.(Ms).No.18 dated 23.01.2020. The learned counsel submitted that the second respondent had misconstrued the provisions of G.O.(Ms).No.18, and failed to consider the beneficial and humanitarian object of the compassionate appointment scheme. The learned counsel submitted that rejection of the petitioner's claim on both grounds, namely delay and minority, is unsustainable. The learned counsel, therefore, seeks quashment of the impugned order passed by the second respondent and a direction to appoint her to a suitable post on compassionate grounds.
5. Heard the learned Government Advocate appearing for the respondents and perused the materials available on record.

On a perusal of the impugned order, this Court finds that the petitioner's application was rejected on the ground that it was submitted beyond three years from the date of death and that she had not attained the age of 18 years within the said three year period as stipulated under the G.O.(Ms).No.18, Labour and Employment Department (Q1), dated 23.01.2020. This Court is of the view that the petitioner herein has misconceived the applicable guidelines and applied for compassionate appointment only after attaining majority,
beyond the prescribed time limit.
7. This Writ Petition stands dismissed with the aforesaid direction. There shall be no order as to costs. Consequently, connected Writ Miscellaneous Petition is closed.
