ORDER

The above writ petition has been filed seeking a mandamus to the respondents 1 and 2 to consider the representation of the petitioner dated 03.10.2025 to disconnect the service connection in SC No.123-080-393 and SC No.124-080-472 standing in the name of death person Mr.Khader, within a time frame fixed by this Court.

The President of the petitioner-Wakf has filed the petition on behalf of Ameerunissa Begum Sahiba Endowment, the petitioner herein and would submit that the petitioner-Wakf, is the absolute and lawful owner of the Waqf property situated at Old Door No.22, New Door No.31, Peters Road, Royapettah, Chennai - 600 014, measuring an extent of 9 acres, comprised in R.S.No.660 of Triplicane-Mylapore Taluk. This property has been registered with Tamil Nadu Waqf Board and has been used as Muslim burial ground, tomb area and staff quarters.

3. The petitioner would submit that one Khader was permitted to occupy a small residential portion in his capacity as a grave digger. After his demise, __________Page 2 of 5

his son, the 3rd respondent herein, was appointed as grave digger, who was later terminated from service on 15.03.2021 for his misconduct. The petitioner would submit that in the place of third respondent, one Nizamudeen was appointed to carry out the burial works, and when this was obstructed by the third respondent, a petition in Crl.O.P.No.11865 of 2021 was filed by the petitionerWakf seeking police protection, and this Court by order dated 31.01.2022, has ordered police protection.

In the meantime, it came to the knowledge of the Wakf that the electricity service connection in SC No.123-080-393 and SC No.124-080-472 is still standing in the name of late Khader, and the third respondent and his brothers are unlawfully using the same. Therefore, the petitioner-Wakf had made representations on 06.09.2025 and 03.10.2025, seeking to disconnect the electricity service connections given in the name of deceased Khader, but the same was not considered to date. Hence, the present writ petition.

5. Heard the learned counsel on either side and also perused the materials placed before this Court.

6. Considering the facts and circumstances of the case, the official respondents 1 and 2 are directed to consider the representations of the petitioner-Wakf and shall pass orders within a period of three weeks from the __________Page 3 of 5

date of receipt of copy of this order, after affording an opportunity of hearing to all the interested parties concerned.
