PRAYER;This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, to direct the Respondent No.3 to 5 herein to release and disburse the annual increment arrears due to the petitioner with effect from July 2025, by considering and disposing of the petitioners representation dated 07.09.2025 within the time frame fixed by this Honble court. ORDER
This petition has been filed seeking a direction to the Respondent No.3 to 5 herein to release and disburse the annual increment arrears due to the petitioner with effect from July 2025, by considering and disposing of the petitioners representation dated 07.09.2025.
2. It is the case of the petitioner that she had taken medical leave from 29.10.2024 to 12.11.2024. Regarding the medical leave, a show cause notice was issued on 23.06.2025, for which, the petitioner has given an explanation. However, the salary for the said period has not been disbursed and increment has also been not given. Hence, the petitioner made a representation to the respondent to disburse the same and the representation is not considered. Hence, the present writ petition.
3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners
representation within the stipulated time as fixed by this Court.
4. The learned Government Counsel appearing for the respondents submitted that the representation will be considered and orders will be passed within the stipulated time as fixed by this Court.
5. Heard the learned counsel for both side and perused the materials available on record.
6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the first respondent to consider and pass orders on the petitioner's representation dated 07.09.2025 within a period of four weeks from the date of receipt of a copy of this order.
