2. Ms.R.Janani representing counsel would submit that Mr.J.Chandran, learned counsel takes notice for the second respondent and she has no objection in allowing this petition.

3. The first petitioner would aver that the bundle was misplaced ; a copy application was belatedly filed; and due to financial constraints, delay of 334 days occurred in filing the above appeal.

4. The reasons assigned by the petitioner in the affidavit appear to be reasonable and acceptable. Therefore, this Court is inclined to allow this petition, subject to the condition that the interest for the delay period of 334 days shall stand waived.
