Respondent(s) PRAYER; The writ petition has been filed under Article 226 of Constitution of India, seeking to issue a writ of Mandamus, directing the respondent herein to revise the pension and Gratuity with 90 Percentage Dearness Allowance and pay the consequential benefits to the petitioner herein by considering the representation of the petitioner dated 07.09.2025 and in the light of orders passed by this Honble Court in WP.No. 29545 of 2025 dated 11.08.2025.

ORDER

This petition has been filed seeking a direction to the respondent herein to revise the pension and Gratuity with 90 Percentage Dearness Allowance and pay the consequential benefits to the petitioner herein by considering the representation of the petitioner dated 07.09.2025 and in the light of orders passed by this Honble Court in WP.No. 29545 of 2025 dated 11.08.2025.

2. It is the case of the petitioner that he joined as Junior Assistant in the respondent Corporation on 06.11.1978 and promoted as Superintendent and retired from service on 31.08.2013. The Government raised the dearness allowance from 80% to 90% w.e.f. 01.07.2013. Before issuance of Government Order, the petitioner retired from service on 31.08.2013. Hence, 10% DA was not taken into account by the respondent for fixation of pension and gratuity. Hence, paid lesser Gratuity and pension. Hence, the petitioner sent representation dated 07.09.2025 to the respondent herein, but it was not considered. Hence, the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.

4. The learned Standing Counsel appearing for the respondent submitted that the representation will be considered and orders will be passed within the stipulated time as fixed by this Court.

5. Heard the learned counsel for both side and perused the materials available on record.

6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the respondent to consider and pass orders on the petitioner's representation dated 07.09.2025 within a period of four weeks from the date of receipt of a copy of this order.

7. With the above directions, the writ petition is disposed of. Consequently, connected miscellaneous petition is closed. No costs.
