JUDGMENT

(Judgment of the Court was delivered by M.S.RAMESH,J.) By placing reliance on the decision of the Hon'ble Full Bench of the Madurai Bench of this Court in the case of S.Dhanasekaran and Others Vs. Madurai Corporation passed in W.P.(MD) No.1083 of 2012 and W.A.(MD) No.555 of 2010, the learned Single Judge had disposed of the Writ Petition in W.P.No.38785 of 2016 on 06.07.2017, extending the relief granted by the Hon'ble Full Bench to the Sanitary Workers, limiting the relief to that of the directions issued by the Hon'ble Full Bench. 2.The decision in S.Dhanasekaran's case (supra) is binding on both the Writ Court, as well as this Bench and thus, it would be impermissible for us to take any contrary view. 3.At this juncture, the learned counsel for the appellants brought to our notice that similar cases relating to regularization of Sweepers are pending before the Hon'ble Supreme Court in Civil Appeal Nos.10441 to 10448 of 2024 and an order of interim stay has also been granted.

4.We are of the view if liberty is granted to the appellants to work out their remedies, subject to the outcome of the Civil Appeals pending before the Supreme Court, the ends of justice could be secured. 5.Accordingly, the Writ Appeal stands dismissed with liberty to the appellants to work out their remedies subject to the final outcome of Civil Appeal Nos.10441 to 10448 of 2024 pending before the Hon'ble Supreme Court.
