ORDER
This Writ Petition has been filed challenging the order dated 24.01.2025 passed by the respondent and quash the same in so far as its denies the salary for the period from 23.12.2024 to 24.01.2025 and consequently direct the respondent to pay the unpaid subsistence allowance for the period from 21.12.2022 to 31.03.2023 and pay salary for the period from 23.12.2024 to 24.01.2025 and also pay the MACP arrears form 24.02.2011 to 08.11.2018.
2. With the consent of the learned counsel appearing on either side, this Writ Petition is taken up for disposal at the admission stage.

The learned counsel appearing for the petitioner would submit that the petitioner was placed under suspension on 23.12.2024 while he was in service as a Conductor on the ground, he has issued a ticket without collecting the amount and when the Checking Inspector queried, it was found that the ticket was issued in one lumpsum. Subsequently, the petitioner was placed under suspension between 23.12.2024 to 10.01.2025 and thereafter, he was issued a warning without any disciplinary proceedings and refused to pay salary between
23.12.2024 to 10.01.2025 and subsequently, he was retired from service on 31.03.2025. After lapse of 10 months, the present writ petition is filed for payment of subsistence allowance for a period from 23.12.2024 to 10.01.2025. The learned counsel appearing for the petitioner would submit that the petitioner is entitled to claim subsistence allowance from 23.12.2024 to 10.01.2025 and the same was not considered. Accordingly, he prayed for appropriate orders.

Admittedly, the petitioner was retired in the month of March, 2025 and prior to that, the petitioner was placed under suspension from 23.12.2024 to 10.01.2025 and without taking disciplinary proceedings, the respondent issued a warning letter and refused to pay salary, for which, the petitioner filed this writ petition after a lapse of 9 months, which is not acceptable one. Hence, the prayer sought for by the petitioner cannot be granted.
5. In view of the above discussion, this Writ Petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed. 09-01-2026 Index: Yes/No Speaking/Non-speaking order KKN
