ORDER

This writ petition has been filed seeking for a direction to the first respondent to consider the petitioner's representation dated 22.04.2022 requesting to cancel the patta bearing No.299 issued in favour of the respondents 2 and 3 for the property morefully described in the prayer to this writ petition.

2. Mr.D.Ravichander, learned Special Government Pleader, accepts notice on behalf of the first respondent. At the first instance, he would submit that the petitioner will have to submit an application seeking for cancellation of patta to the concerned Revenue Divisional Officer, and not to the first respondent.

3. The learned counsel for the petitioner on instructions would submit that the petitioner is willing to submit a fresh application to the concerned Revenue Divisional Officer seeking for cancellation of patta issued in favour of the respondents 2 and 3. The said undertaking given by the learned counsel for the petitioner is hereby recorded by this Court.

4. Since the Revenue Divisional Officer, Chengalpattu, is not arrayed as party respondents, this Court suo-moto impleads Revenue Divisional Officer, __________Page 2 of 5

Chengalpattu, as party fourth respondent in this writ petition. Mr.D.Ravichander, learned Special Government Pleader, accepts notice on behalf of the newly impleaded fourth respondent as well.

5. No prejudice will be caused to the official respondents, if the petitioner is directed to submit a fresh application to the newly impleaded fourth respondent seeking for cancellation of patta No.299 issued in favour of the respondents 2 and 3 for the subject property, and a further direction is issued to the newly impleaded fourth respondent to pass final orders, on merits and in accordance with law, on receipt of such application from the petitioner.

6. Accordingly, this writ petition is disposed of in the following manner:- (a) The petitioner is directed to submit a fresh representation to the newly impleaded fourth respondent seeking for cancellation of patta issued in favour of the respondents 2 and 3 for the property morefully described in the prayer to this writ petition, within a period of two weeks from the date of receipt of a copy of this order. (b) On receipt of the said representation, the newly impleaded fourth respondent shall pass orders, on merits and in accordance with law, on the said application, after hearing the objections from the respondents 2 and 3, as well as any __________Page 3 of 5

other party whom the newly impleaded fourth respondent deems fit to enquire, within a period of 12 weeks thereafter. No Costs.
