Respondent(s) PRAYER This petition has been filed seeking for issuance of a Writ of Mandamus to direct the respondents to conduct a preliminary enquiry and take a decision in the light of law laid down in Lalitha Kumari case in pursuant to the complaint

of petitioner dated 23.10.2025 and consequently take an appropriate criminal action against the accused.

ORDER

This petition has been filed seeking for issuance of a Mandamus to direct the respondents to conduct a preliminary enquiry and take appropriate action based on the complaint of petitioner dated 23.10.2025 against the accused, in the light of the law laid down in Lalitha Kumari case. 2.The learned counsel for the petitioner would submit that no proper enquiry was conducted.

3.Today when the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that based on the complaint of the petitioner dated 23.10.2025, enquiry was conducted in current paper no.1816 by the 4th respondent. During the enquiry, the petitioner has stated that he will approach the civil Court and work out his remedy. Based on the same, the complaint has been closed.

4.In view of the submission made by the learned Additional Public Prosecutor, this petition stands closed. However, liberty is granted to the petitioner to challenge the closure report, if so advised. No costs. 06-01-2026 dn
