The first respondent herein was the writ petitioner, who was an employee of the appellant Transport Corporation and after attaining the age of superannuation, he retired peacefully, but his retiral benefits since has not been paid, he approached the writ court by filing the aforesaid writ petition. The learned Writ Court allowed the writ petition through the impugned order dated 12.09.2025.

Though as against the said order the present writ appeal has been filed, Mr.C.Vigneswaran learned counsel for the first respondent / writ petitioner submits that the order of the writ Court has been substantially complied with and only a small portion of the order is yet to be complied with, and therefore the appeal has become infructuous. However, learned counsel for the appellant Transport Corporation made an attempt to assail the order, which is impugned herein.

4. We, after having gone through the order passed by the Writ Court, is not impressed with the submission made by the learned counsel for the appellant. As the first respondent / writ petitioner has peacefully retired from service, insofar as his retiral benefits are concerned, it should have been paid within a period which has been fixed under the Statute. However, since the same has not been paid it was directed to be paid in twelve equal instalments with interest at the rate of 9% per annum. The said order passed by the Writ Court is fully justifiable and therefore, we do not wish to interfere with the same.

5. In that view of the matter, we are not inclined to entertain this writ appeal and the same stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
