ORDER

The petitioner herein, who was arrested and remanded to judicial custody on 27.06.2025 for the offences punishable under Sections 331(4) & 305(a) of BNS in C.C.No.565 of 2025 on the file of the Hon'ble Judicial Magistrate No.2, Nagapattinam, seeks bail.

2. The case of the prosecution is that on 26.06.2025 at about 18.00 hours, the petitioner, along with two others, committed theft from the defacto complainant's house and stolen one Laptop, one Iron box and two brass candlesticks. Hence, a case was registered and the petitioner was arrested.

3. The learned counsel appearing for the petitioner submitted that this is the third bail application and that he has been falsely implication, on account of some previous cases pending against them; that the petitioner is in judicial custody since 27.06.2025. Hence, he prayed to grant bail to the petitioner.

4. The learned Government Advocate appearing for the respondent submitted that the investigation was completed and the final report was also filed. The case was taken on file in C.C.No.565 of 2025 by the Judicial Magistrate No.II, Nagapattinam and is now posted for examination of witnesses. However, the petitioner is involved in 11 previous cases, he opposed to grant bail to the petitioner.

5. Earlier, this Court dismissed the bail petitions filed by the petitioner for on two occasions on the ground that the petitioner is involved in 11 previous cases. Since there is no change in circumstances has been established before this Court to warrant reconsideration of the earlier orders, this Court is not inclined to grant bail to the petitioner.
