Prayer Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus forbearing the respondents 1 to 3 from issuing patta for the land measuring 5 Acres 88 cents comprised in S.Nos.365/2, 378/3A, 378/3B and 500/7 situated in U.Keeranur village Ulundurpettai Taluk, Kallakurichi District till the disposal of title /civil 1/6

dispute pending between the petitioner and respondents herein and direct the respondents 1 to 3 to cancel patta Nos.2645 1355, 561, 195 and 525 issued in favour the respondents 4 to 10 by considering the representation dated 30.10.2025.

2. This Writ Petition has been filed to forbear the respondents 1 to 3 from issuing patta and to direct the respondents 1 to 3 to cancel the patta Nos.2645, 1355, 561 and 525 issued in favour of the respondents 4 to 10 based on the petitioner's representation dated 30.10.2025.

3. Insofar as the first limb of the prayer, in this Writ Petition, viz., to forbear the respondents 1 to 3 from issuing patta is concerned, since pattas have already been granted in favour of the private respondents, viz., respondents 4 to 10, through patta Nos.2645, 1355, 561, and 525, the same 2/6

cannot be granted. Only second limb of the prayer, viz., to direct the respondents 1 to 3 to cancel the pattas issued in favour of respondents 4 to 10 can be considered on merits and in accordance with law within a time frame to be fixed by this Court.

4. Mr.C.Jayaprakash learned Government Advocate accepts notice for the respondents 1 to 3. Since no positive direction has been issued by this Court for cancellation of the aforementioned pattas standing in the names of the private respondents, viz., respondents 4 to 10 and since no adverse orders are being passed against them, notice to them is dispensed with by this Court.

5. No prejudice would be caused to the official respondents, if the petitioner's representation dated 30.10.2025 is considered on merits and in accordance with law, after hearing the objections of the respondents 4 to 10 as well as any other third party, whom, the second respondent deems it fit to enquire within a time frame to be fixed by this Court. This Court is not expressing any opinion on the merits of the representation made by the petitioner.

For the foregoing reasons, this Court directs the second respondent to pass final orders on merits and in accordance with law on the petitioner's representation dated 30.10.2025 seeking for cancellation of patta issued in favour of respondents 4 to 10 after hearing the objections of the respondents 4 to 10 as well as any other third party, whom, the second respondent deems it fit to enquire within a period of twelve weeks from the date of receipt of a copy of this order.

7. With the aforesaid direction, this Writ Petition is disposed of. No costs.
