ORDER

This Criminal Original Petition has been filed seeking to quash the Special Report filed in Spl.SC.No.145 of 2025 on the file of the learned Principal Sessions Judge, Ranipet.

2.The case of the prosecution is that the petitioner is the 2nd accused, the 1st accused abducted the minor victim girl and took her from the lawful guardianship and kept her in the house belonging to the petitioner / 2nd accused, thereby she has abetted the offence.

3.Learned counsel appearing for the petitioner would submit that the petitioner is the aunt of the 1st accused and other than allowing the 1st accused and the victim minor girl to stay in her house, she has not committed any offence.

4.Learned Government Advocate (Crl. Side) would submit that the charge against the petitioner / 2nd accused is for offences under Section 10 r/w 17 of the POCSO Act, 2012 and the petitioner has allowed the 1st accused to have the minor victim in her house.

5.At this juncture, learned counsel appearing for the petitioner sought permission of this Court to withdraw this petition and he has also made an endorsement to that effect. Further, he sought the indulgence of this Court to dispense with the personal appearance of the petitioner before the trial Court.

6. In view of the submission and endorsement made by the learned counsel appearing for the petitioner as regards withdrawal, this Criminal

Original Petition stands dismissed as withdrawn. Consequently, the connected miscellaneous petitions are closed.

7.However, acceding to the request made by the learned counsel for the petitioner, the personal appearance of the petitioner before the trial Court is dispensed with, except for receipt of copies, answering the charges, questioning under Section 313 Cr.P.C., passing of judgment, or any other date as may be required by the trial Court.
