O R D E R

This writ petition has been filed for the following relief:- "directing the 3rd respondent The Revenue Divisional Officer, O/O, Revenue Divisional Office, North Chennai Revenue Division,Chennai.66 to consider the petitioner's representation given to the 1st respondent dated 14.02.2023 and the same was forwarded to the 3rd respondent and the same is pending vide reference No.NA.KA.No.A5/636/2023 dated 08.03.2023 before the 3rd Respondent and pass such further order or direction and thus render justice."

2. The petitioner is the second wife of late Parthasarathy. They were married on 15.02.2002 and the marriage was registered as Serial No.284 of 2008 dated 17.10.2008, on the file of the Sub-Registrar, Tiruvottiyur. After the marriage, the petitioner resided with her husband at No.25/7, Appasamy 2/6

Koil Street, Tiruvottiyur, Chennai, and they lived together until his death on 12.07.2010. After the demise of the said Parthasarthy, the children of the first wife performed the last rites.

3. While so, the 4th respondent had issued a Legal Heir Certificate dated 03.11.2010 excluding the petitioner's name, despite her objections. Thereafter, the petitioner requested the 3rd respondent to cancel the said Legal Heir Certificate and to include her name as a legal heir. Since the petitioner's request for cancellation of the said certificate and inclusion of her name as a legal heir has been pending before the 3rd respondent for a considerable period of time, the petitioner had submitted a representation dated 14.02.2023 to the 1st respondent seeking cancellation of the Legal Heir Certificate dated 03.11.2010 issued by the 4th respondent and issuance of a fresh Legal Heir Certificate including her name. The 1st respondent had forwarded the said representation to the 2nd respondent and the 2nd respondent in turn had forwarded the same to the 3rd respondent, who is the competent authority to take necessary action on the petitioner's request. However, to date, no orders have been passed by the 3rd respondent. Hence, the Writ Petition.

4. Heard the learned counsel on either side and perused the records. 3/6

Considering the limited request of the petitioner and also taking note of the fact that the petitioner's representation dated 14.02.2023 has not been disposed of to date, the 3rd respondent is directed to consider and dispose of the petitioner's representation dated 14.02.2023, on merits and in accordance with law, within a period of 4 weeks from the date of receipt of a copy of this order.
