ORDER

This petition has been filed seeking a direction to the respondents to

consider the petitioner representation dated 22.08.2023 and thereby direct the respondents to give service benefits to the petitioner.

2. It is the case of the petitioner that he was appointed as Thalaiyari on 15.11.1976 and served continuously without any break till 1979. While he was on medical leave from 06.09.1979, a temporary appointment was made in his place. After recover and expiry of medical leave, the petitioner reported for duty on 07.11.1979, however, he was not permitted to rejoin duty, despite repeated requests. Therefore, the petitioner submitted several representations dated 04.06.2003, 17.07.2006 and 08.02.2007 seeking reinstatement and posting and the same was not considered. Hence, the petitioner filed a writ petition before this court. This Court while disposing the writ petition, on 16.04.2010, directing the respondents to consider the petitioners directions. Pursuant to the said order, the 3rd respondent, by proceedings dated 15.12.

2011, recommended appointment of the petitioner as Village Assistant. However, no further action was taken and the petitioner was allowed to attain superannuation without being given posting or service benefits. Subsequently, the petitioner made a representation on 22.07.2020, 27.07.2020 and 22.08.2023 seeking service benefits. Though the second respondent directed the 3rd respondent to take appropriate action, no relief was granted. Hence, the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may

direct the respondents to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.

4. The learned Additional Government Pleader appearing for the respondent submitted that the representation will be considered and orders will be passed within the stipulated time as fixed by this Court.

5. Heard the learned counsel for both side and perused the materials available on record.

6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the first respondent to consider and pass orders on the petitioner's representation dated 22.08.2023 within a period of four weeks from the date of receipt of a copy of this order.
