PRAYER Writ Petition filed under Article 226 of the Constitution of India, seeking issuance of a Writ of Mandamus, directing the 1st Respondent to consider the petitioner for promotion to the post of District backward Classes and Minorities Welfare officer or its equivalent post on the basis of his notional senitority as fixed by the 3rd Respondent vide his proceedings in Se. ORDER

This Writ Petition has been filed seeking to direct the 1st Respondent to consider the petitioner for promotion to the post of District backward Classes and Minorities Welfare officer or its equivalent post on the basis of his notional seniority, as fixed by the 3rd Respondent vide his proceedings in Se.Mu.No A2/ 2922/2012-2 dated 05.01.2023 and by considering petitioner's representations dated 27.09.2023 and 08.12.2025.

2. Mr.R.V.Dinesh Raj Kumar, learned Additional Government Pleader takes notice on behalf of the respondents. In view of the consent expressed by

the learned counsel on either side, the Writ Petition is taken up for final disposal at the stage of admission itself.

The case of the petitioner is that the petitioner was initially appointed as Junior Assistant in a Government Higher Second School at Vellamalaipatti, Madurai District on 31.08.2001, and subsequently, he was promoted to the post of Assistant on 01.07.2022, with notional effect from 09.04.2007. Consequently, he was promoted as Superintendent on 18.01.2023, with notional effect from 03.11.2014. The grievance of the petitioner is that though the petitioner is eligible for the next avenue of promotion to the post of District Backward Classes and Minorities Welfare Officer, when representations dated 27.09.2023 and 08.12.2025 were made before the respondents, neither of which has been considered to date. Therefore, the petitioner has preferred the present Writ Petition.

Learned Counsel appearing for the petitioner submits that since the petitioner is eligible for promotion to the post of District backward Classes and Minorities Welfare officer, it would suffice if this Court issues a direction to the first respondent to consider the petitioner's representations dated 27.09.2023 and 08.12.2025, on the basis of his notional seniority, as fixed by the 3rd Respondent vide his proceedings in Se.Mu.No A2/ 2922/2012-2 dated 05.01.2023, and pass appropriate orders on the same within the time that may be

stipulated by this Court.

5. On the above contention, this Court heard the learned counsel appearing for the respondent.

6. In view of the limited relief sought for by the petitioner, this Court without expressing any opinion on the merits of the case, directs the first respondent to consider the petitioner's representation dated 08.12.2025 on merits and pass appropriate orders on the same in accordance with law within a period of six (6) weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner and any other interested parties.

7. This Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
