ORDER

The writ petition criminal has been filed to direct the 2nd respondent to file a preliminary report or a final report as the case may be within a period of 4 weeks.

2.The petitioner sent a complaint on 06.05.2025 to the respondent making serious allegations against the SRO, Magudanchavadi, Surveyor and Revenue Officials.

This complaint was received and assigned petition No.5842/2025/REGN/SL dated 12.05.2026 and communication was sent to the petitioner from the Superintendent of Police, Western Range, Vigilance and Anti-Corruption, Chennai - 16, informing that as per the guidelines issued in G.O.Ms.No.173, P & AR (N) Department dated 19.12.2018, since the content of the petitioner requires verification of documents, the complaint has been forwarded to Inspector General of Registration, Chennai, for taking necessary action at their end. Thereafter, petitioner was not informed any further action hence, he filed this writ petition.

3.Counsel for the petitioner referring to G.O.Ms,No.173, P & AR (N) Department dated 19.12.2018 submitted that the petitioner had specific complaint against SRO, Surveyor and Revenue officials. As per

G.O.Ms.No.173, for obtaining prior permission under Section 17(A)(1) guidelines have been issued in the G.O. but this guidelines have not been followed.

4.The learned Govt. Advocate (Crl.Side) filed a status report submitting that the complaint was received and forwarded to the Inspector General of Registration, Chennai. Further, on scrutinizing the petitioner's complaint by V & AC, it was found that there is no prima facie material attracting offences under Prevention of Corruption Act. Further, the contents of the petitioner required verification of documents by the competent authority. Hence, the complaint was forwarded to the Inspector General of Registration, Chennai and copies were marked to the Collector, Salem and Superintendent of Police, Salem, for taking necessary action. The District Registrar (Admin), Salem West, in his letter No.7020/E4/2025 dated 12.01.2026 informing that the appeal petition of one Murugesan S/o.

Kesava Pillai, who is purchaser of the property under dispute was accepted by the District Registrar of Salem West and under Section 72 of Registration Act and issued orders to the Sub Registrar of Magudanchavadi on 20.06.2023, to register the sale deed in pending document No. P114/2022 following the circulars of the Inspector General of Registration, Chennai and the Registration Acts and Rules. Hence, the District Registrar pending documents was registered on 25.08.2023.

The enquiry officer has been nominated to collect additional information and documents to complete the enquiry and submit a report on the complaint of the petitioner. 5.Today, the learned Govt. Advocate (Crl.Side) produced the letter of District Collector, Salem in e/f/.e-1812/2025/m2 dated 06.02.2026 confirming that on the complaint of the petitioner, charges have been initiated against one Arivudainambi former Thasildar, Sangagiri and Selvaraj former Revenue Inspector under Section 17(b) of the Tamil Nadu Civil Services (Discipline and Appeal) Rules.

6.Considering the above submissions and on perusal of the materials available on record, it is seen that possession certificate was mistakenly issued in the name of Murugesan. In respect of the said irregularity, enquiry initiated against Arivudainambi former Thasildar, Sangagiri and Selvaraj former Revenue Inspector. Recording the same, the writ petition criminal is disposed of.
