The Criminal Original Petition has been filed seeking to quash the First Information Report in Crime No.60 of 2024, pending on the file of the first respondent Police.

The case of the prosecution as per the de facto complainant is that he was induced through message links received via Telegram application from unknown IDs to invest in online trading by promising high returns with low risk. Initially, the de facto complainant invested a small amount and earned a profit of Rs.900/-, which was credited to his bank account. Thereafter, on further inducement, he invested a total sum of Rs.13,41,193/- through various bank accounts. Though a profit of Rs.70,243/- was reflected, the said amount could not be withdrawn and the de facto complainant was allegedly asked to invest additional money. Hence, the complaint.

The learned counsel for the petitioner submitted that the petitioner is an innocent and he was cheated by the other accused. He further submitted that the alleged amount of Rs.70,243/- has been repaid to the de facto complainant.

The learned Government Advocate (criminal side) appearing for the first respondent submitted that it is an online scam and that the petitioner, along with other accused, had urged the de facto complainant to deposit amounts into a bank account on the inducement of paying a higher amount. He further submitted that the investigation is pending. He also submitted that since it is a cyber crime, the respondent Police are taking time to collect the materials and there are documentary materials to show that the inducement was made only by the petitioner and that the amounts were deposited by the de facto complainant.

Heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) for the first respondent and perused the materials available on record.

Taking into consideration the fact that the investigation is pending and that there are materials against the petitioner, this Court is not inclined to quash the proceedings in Crime No.60 of 2024. Hence, this Criminal Original Petition is dismissed. Consequently, connected Miscellaneous petition is closed.

However, taking into consideration that the First Information Report has been pending since the year 2024, a direction is issued to the first respondent to complete the investigation as expeditiously as possible preferably within a period of three months from the date of receipt of a copy of this order and file the final report. 08.01.2026 vkr To 1.
