O R D E R

This Writ petition has been filed for the issue of a Writ of Mandamus directing the respondents to grant adequate police protection by considering the petitioner's representation dated 13.12.2025 in Survey No.Ka.Sa.No.252/2 and in resurvey Ka.Sa.No.252/2D2, 2D3, 2D4 at Kaniyur Village, Sulur Taluk, Coimbatore District and the interim order dated in I.A.No.2/2025 in O.S.No.1102 of 2025 on the file of Principal Sub Court, Coimbatore.

2.It is the case of the petitioner that he is the absolute owner of the property in question. He has filed O.S.No.1102 of 2025 on the file of Principal Sub Court, Coimbatore, and has also filed I.A.No.2 of 2025 in O.S.No.1102 of 2025 seeking interim injunction, in which, the trial Court has granted ad interim ex parte temporary injunction in favour of the plaintiffs(the first plaintiff being the petitioner herein) in the interest of justice and also to preserve the valuable right of the petitioners/plaintiffs 2/4

therein. However, the respondents 4 and 5 herein allegedly attempted to tresspass into the said property, which stands in the name of the petitioner. Hence, the petitioner submitted a representation dated 13.12.20225 to the respondents-police seeking police protection and as the said representation was not considered, the present writ petition (Criminal) has been filed. 3.

3.The learned Additional Public Prosecutor appearing for the respondents 1 to 3 submitted that the respondents 4 and 5 are relatives of the petitioner and that a civil dispute is pending between the parties in respect of the property. Based on the petitioner's representation dated 13.12.2025, an enquiry was conducted in C.S.R.No.116 of 2025 and upon finding that the issue is civil in nature, the parties were directed to approach the competent civil Court.

4. Recording the above submission this writ petition (Criminal) is closed.
