ORDER

The above Writ Petition has been filed for the following reliefs:- " directing the 2nd Respondent Tahsildar, Avadi Taluk to consider and pass reasoned orders by considering the petitioner's representation dated 17/11/2025, seeking cancellation of the fabricated Legal Heir Certificate bearing No.3553 /2016 / A3 dated 22/06/2016, allegedly issued in favour of Late Mrs. Meghala Bai and Ms. Kanimozhi, after conducting due enquiry, within a time frame to be fixed by this Honorable Court."

2. The case of the petitioner is that she is the daughter and one of the lawful legal heirs of Late Mr. V. Munivel, who passed away on 12.02.2013 at Chennai. His wife, Late Mrs. Lakshmi, had predeceased him on 21.07.1984. The funeral rites of the deceased were performed at Nungambakkam Burial Ground, Chennai.

3. The petitioner would submit that Late Mr. V. Munivel had relationships with three women, namely, (i) Mrs. Lakshmi, (ii) Mrs. P.K.

Suguna, and (iii) Mrs. Meghala Bai. Through the said relationships, four children were born, including the petitioner herein. According to the petitioner, all the said children are the genuine legal heirs entitled to succeed to the estate of the deceased.

4. The petitioner would further submit that the immovable property situate at New No. 9, Old No. 50, West Mada Street, Nungambakkam, Chennai - 600 034, measuring about 598 sq. ft., is the self-acquired property of the deceased, constructed out of his own funds.

While so, the petitioner was shocked to learn about a purported Legal Heir Certificate dated 22.06.2016, allegedly issued by the Tahsildar, Avadi Taluk, in favour of Mrs. Meghala Bai and Ms. Kanimozhi alone. The petitioner would contend that the deceased neither resided within the jurisdiction of Avadi Taluk nor did his death occur within the said jurisdiction.

6. The petitioner would further submit that upon verification, the said Legal Heir Certificate is not traceable in the official records of the Avadi Taluk Office. According to the petitioner, the said certificate has been fabricated and fraudulently created, without conducting any enquiry and by completely excluding the genuine legal heirs. Therefore, the petitioner had submitted a representation dated 17.11.2025 to the 2nd respondent seeking an enquiry into

the issuance of the impugned Legal Heir Certificate, cancellation of the same, and issuance of a fresh Legal Heir Certificate in favour of all the genuine legal heirs. However, no action has been taken on the said representation to date. Hence, the Writ Petition.

7. Heard the learned counsel on either side.

8. Considering the facts and circumstances of the case and taking note of the fact that the petitioner's representation dated 17.11.2025 has not been considered to date, the Writ Petition is allowed. The 2nd respondent is directed to dispose of the petitioner's representation dated 17.11.2025, on merits and in accordance with law, after affording an opportunity of hearing to all interested parties, within a period of 4 weeks from the date of receipt of a copy of this order. No costs.
