ORDER

The civil revision petition is filed seeking to strike off the name of the petitioner from the array of parties in MATCOP No. 181/2025 on the file of Motor Accident Claim Tribunal, Sub Court, Sathyamangalam.

2. The 1st respondent herein filed a claim petition seeking compensation for the injury suffered in a road accident involving a car with registration number TN-07 BM 9364. The MCOP has been filed against the petitioner, arraying him as 2nd respondent in MCOP. No. 181/2025. The 2nd respondent is the driver of the vehicle and the petitioner is the owner of the offending vehicle.

The instant civil revision petition has been filed by the petitioner seeking to strike off his name from the array of parties mainly on the ground that the accident had taken place on 16.05.2025 and he sold the vehicle as early as 2022 in favour of one Christina Koilraj. In support of the said claim, the petitioner filed various documents like delivery note, registration certificate downloaded from the online portal, etc. In the registration certificate, the name of Christina Koilraj was mentioned as the owner of the vehicle. However, it is not clear when the transfer of vehicle had been taken place, whether Christina Koilraj was the registered owner of the vehicle on the date of accident namely 16.05.2025 is not clear in the registration certificate.

In such circumstances, this court cannot accept the contention raised by the petitioner to strike off his name from the array of parties. It is always open to the petitioner to appear before the Tribunal, file his counter and bring it to the notice of the Tribunal that on the date of accident, he was not the registered owner of the vehicle. Whether the petitioner was the registered owner of the vehicle on 16.05.2025 is a matter for evidence and therefore, this court is not inclined to exercise its power to strike off the name of the petitioner from the array of parties.

4. Accordingly, the civil revision petition stands dismissed with liberty to the petitioner to raise all his defence before the Tribunal by filing his counter. No costs.
