ORDER
This writ petition has been filed seeking for a direction to the official respondents to shift the TASMAC shop from the land of the fourth respondent at the address morefully disclosed in the affidavit filed in support of this writ petition, based on the petitioner's representation dated 08.09.2025.
2. The petitioner claims to be a resident of the area in which the TASMAC shop in question is located. The petitioner seeks for shifting of the same, since the TASMAC shop in question causes public nuisance to the residents of that area. The petitioner had given a representation on 08.09.2025 to the official respondents seeking for shifting of the TASMAC shop in question from the land of the fourth respondent. Since the said representation has not been considered till date, the petitioner has filed this writ petition.
3. Mr.P.Anandakumar, learned counsel, accepts notice on behalf of the respondents 1 and 2; and Mr.P.Sathishkumar, learned counsel, accepts notice on behalf of the third respondent. Since no adverse orders are passed against the fourth respondent, notice to the fourth respondent in this writ petition is dispensed with.
4. No prejudice will be caused to the official respondents, if the aforesaid representation of the petitioner is considered, on merits and in accordance with
law, after hearing the objections from the fourth respondent as well as any other party whom the official respondents deem it fit to enquire, within a time frame to be fixed by this Court. Accordingly, this writ petition is disposed of by directing the second respondent to pass final orders on the petitioner's representation dated 08.09.2025 seeking for shifting of the TASMAC shop in question from the land of the fourth respondent, after hearing the objections from the fourth respondent as well as any other party whom the second respondent deems it fit to enquire, within a period of 12 weeks from the date of receipt of a copy of this order. This Court is not expressing any opinion on the merits of the aforesaid representation of the petitioner. No Costs. W.M.P.No.6539 of 2026 is closed.
