ORDER
This writ petition has been filed to forbear the second respondent from conducting any enquiry in the patta cancellation proceedings initiated by the fourth respondent for the property, morefully described in the prayer to this writ petition.
2.The petitioner in this writ petition claims that since there are civil suits pending over the property, for which the fourth respondent has sought for cancellation of patta, the second respondent ought not to have commenced proceedings, based on the fourth respondent's application seeking for cancellation of the petitioner's patta.
3.Mr.D.Ravichander, learned Special Government Pleader accepts notice on behalf of the respondents 1 to 3. Since no adverse order is passed against the fourth respondent in this writ petition, notice to the fourth respondent is dispensed with.
4.Even before a final order could be passed by the second respondent, based on the fourth respondent's application seeking for cancellation of patta, the petitioner has approached this Court by filing this writ petition pre-maturely. The petitioner will have to raise all her objections with regard to the pendency of the civil suits over the subject property only before the second respondent,
who has commenced proceedings, based on the fourth respondent's application seeking for cancellation of the petitioner's patta. 5.It is for the second respondent to take a final decision after considering the petitioner's objection which have been raised in this writ petition. 6.Instead of raising the same before the second respondent, the petitioner has filed this writ petition pre-maturely. It is made clear that the second respondent will have to consider all the objections that have been raised by the petitioner, which includes the pendency of the civil suits, before passing a final order on the fourth respondent's application seeking for cancellation of the petitioner's patta.
7.For the foregoing reasons, this writ petition is disposed of by directing the petitioner to raise all objections, which have been raised in this writ petition before the second respondent on the application filed by the fourth respondent seeking for cancellation of the petitioner's patta and the second respondent shall consider the same, on merits and in accordance with law and only thereafter, take a final decision on the fourth respondent's application seeking for cancellation of the petitioner's patta. Consequently, connected WMP is closed. No costs.
