ORDER
This Writ Petition has been filed seeking for a direction to the 2nd respondent to consider the petitioner's objections for transfer of the revenue records in favour of the respondents 3 and 4 for the property morefully described in the affidavit filed in support of this writ petition, based on her representation, dated 28.10.2025.
2. Mr.D.Ravichander, learned Special Government Pleader, accepts notice on behalf of the respondents 1 and 2. Since no adverse order is passed against the respondents 3 and 4, notice to the respondents 3 and 4 is dispensed with.
3. The grievance of the petitioner in this writ petition is that she had executed a settlement deed in favour of the 3rd respondent (son) for the property morefully described in the affidavit filed in support of this writ petition. According to the petitioner, the settlement is a conditional Page No.2 of 6
settlement and the 3rd respondent did not have the power to alienate the property. But, despite the same, according to the petitioner, the 3rd respondent had further settled the property in favour of his wife, the 4th respondent herein, by executing a registered settlement deed. The petitioner apprehends that the 3rd respondent is attempting to transfer the revenue records in favour of the 4th respondent by virtue of the settlement deed executed by him in favour of the 4th respondent.

However, it is to be noted that the petitioner has already filed a civil suit seeking for a declaration that she is the absolute owner of the property and she has also sought for cancellation of the settlement deed executed by the 3rd respondent in favour of the 4th respondent in the said suit. Since the petitioner has already filed a civil suit, necessarily, the relief sought for in this writ petition cannot be entertained as the grievance of the petitioner can only be redressed in the civil suit filed by the petitioner against the respondents 3 and 4.
5. The learned counsel for the petitioner also submitted that since this Court is not inclined to entertain this writ petition, the petitioner may Page No.3 of 6
be granted liberty to seek for redressal of all her grievance, which includes the relief as prayed for in this writ petition, before the Civil Court in the civil suit in O.S.No.162 of 2025 on the file of the District Munsif Court, Ponneri in the manner known to the petitioner under law.
6. No prejudice would be caused to any of the respondents, if such a liberty is granted.
7. In view of the fact that a civil suit has already been filed by the petitioner, this Writ Petition is disposed of by granting liberty to the petitioner to seek for all remedies, which includes the remedy sought for in this writ petition, in the civil suit, namely O.S.No.162 of 2025 on the file of District Munsif Court, Ponneri, in the manner known to the petitioner under law. No costs.
