ORDER

The Revision challenges the dismissal of the petitioner's application seeking registration of FIR as against the proposed accused, who are police officials.

2.The gist of the case of the petitioner is that the proposed accused are harassing the petitioner in the guise of investigation; that on one occasion, they had illegally detained the petitioner's elder brother and threatened him that they will not release him if he does not disclose the petitioner's whereabouts and had also insulted the petitioner's sister and abused her in vulgar language. Since the respondent refused to register a complaint against the proposed accused, the petitioner has filed a petition under Section 175(3) of BNSS before the learned Magistrate seeking registration of FIR.

3.The learned Magistrate by the impugned order, dismissed the said petition on the ground that the complaint cannot be registered without any material to support the petitioner's case and had observed that this Court's order dated 03.04.2025 in Crl.O.P.No.9998 of 2025 has to be strictly complied by the all the parties concerned. The learned Magistrate has also observed that the Magistrate would exercise supervision over the enquiry and investigation and ensure that the proposed accused comply with the provisions of law and the directions issued by this Court in Crl.O.P.No.9998 of 2025. 4.This Court finds that there is no material to direct registration of FIR as against the proposed accused. However, the respondent shall ensure that any

investigation conducted by them shall be strictly in accordance with law and in compliance with the directions issued by this Court in Crl.O.P.No.9998/2025. 5.Accordingly, the Revision is dismissed.
