ORDER

This writ petition has been filed seeking for a direction to the respondents to survey and demarcate the boundaries of the property morefully described in the prayer to this writ petition, based on the petitioner's representation dated 15.06.2024, and in compliance with the earlier order passed by this Court in W.P.No.22761 of 2024, dated 12.08.2024.

2. Mr.S.Arumugam, learned Government Advocate, accepts notice on behalf of the respondents 1 and 3.

3. Earlier, the very same petitioner had approached this Court by filing a writ petition in W.P.No.22761 of 2024 seeking for the very same relief. In the said writ petition, this Court, vide its order dated 12.08.2024, directed the respondents to consider the petitioner's application seeking for survey and demarcation of the boundaries of the subject property. The grievance of the petitioner is that till date, survey and demarcation of the boundaries has not been completed, despite the directions issued by this Court in W.P.No.22761 of 2024, dated 12.08.2024.

4. No prejudice will be caused to the respondents 1 to 3, if the aforesaid representation of the petitioner is considered, on merits and in accordance with __________Page 2 of 4

law, after hearing objections if any from the neighbouring land owners as well as any other party whom the respondents 1 to 3 deem fit to enquire. Accordingly, this writ petition is disposed of in the following manner:- (a) Before surveying the land in question, the respondents 1 to 3 are directed to issue notice to the neighbouring land owners, and also to any other party, whom they deem fit to enquire.

(b) After receiving objections if any and after considering the same, the respondents 1 to 3 shall conduct survey and demarcate the boundaries of the property morefully described in the prayer to this writ petition, on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order.

(c) If any need arises, the respondents 1 to 3 are permitted to submit a petition for police assistance, and upon receipt of such request, the fourth respondent shall render necessary police assistance for conducting survey and demarcation of the subject property.
