Prayer: Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus to call for the records pertaining to the Impugned Order Na.Ka.No.TNDCE/1730/2025-D2 dated 18.03.2025 passed by the 2nd Respondent and quash the same and consequently to direct the respondents 1, 2 and 4 to implement the revised guidelines issued by the 3rd respondent and to pay enhance rate of Rs.1500/- per lecture subject to a maximum of Rs.50,000/- per month along with at 10% interest per annum to each of the members of the Petitioners' Association the details of members with effect from 28.01.2019 with the time stipulated by this Hon'ble Court. O R D E R
The present Writ Petition has been filed challenging the order passed by the 2nd respondent dated 18.03.2025, in and by which, the petitioner's request for payment of enhanced rates of honorarium as per the revised guidelines dated 28.01.2019 of the 3rd Respondent to the guest faculties who possess the qualification as prescribed in UGC Regulations was rejected.
2. It is the case of the petitioner that the members of the petitioner association who are presently working as guest lecturers across the state of Tamil Nadu are not paid in accordance with the revised guidelines issued by the 3rd 2/4
respondent dated 28.01.2019 and on par with the regular lecturers and that they are continued to pay only a sum of Rs.15,000/- per month despite the order passed by this Court in Writ Petition in W.P.No.1331 of 2021 filed by the petitioner, wherein, a direction was issued to the Government to enhance the rates of honorarium to Guest lecturers. Hence, the present Writ Petition.
3. Learned Additional Government Pleader appearing for the respondents submitted that already the petitioner had filed a contempt petition alleging noncompliance of the order and the same was closed.
4. In view of the fact that already a decision is in favour of the petitioner and alleging non-compliance of the same, the Contempt Petition filed and was closed, which is not disputed, recording the submission of the learned Additional Government Pleader, the Writ Petition stands disposed of with liberty to the petitioner to work out the remedy in the manner known to law.
