ORDER
(Order of the Court was made by K.Kumaresh Babu J.) The civil miscellaneous petition has been filed to extend the time granted to comply with the directions as ordered on 24.11.2025 in CMP.No.28183 of 2025 in the above Case in OSA(CAD).No.121 of 2025.
2. The petition had been taken out by the petitioner, who is the appellant, seeking for extension of time to comply with the interim order of stay granted by this Court on 24.11.2025.
3. The petitioner had suffered a money decree, against which the present appeal had been filed and the Coordinate Division Bench of this Court, by its order dated 24.11.2025, had granted interim stay of all further proceedings pursuant to the judgment and decree impugned in this appeal on condition that the appellant deposits Rs.10,00,00,000/- (Rupees Ten Crores only) to the credit of the suit within a period of four weeks.
4. However, expressing inability to mobilize funds, the petitioner had filed the present petition, seeking extension of time by a period of eight weeks for complying with the order dated 24.11.2025. It is to be noted that the said petition had been taken out by the petitioner on an affidavit sworn on 18.12.2025 and even by efflux of time as of today, the period of eight weeks has expired.
5. In such view of the matter, we are of the view that no further orders are required to be made in this petition, as the petition had become infructuous by efflux of time.
6. For the aforesaid reasons, the civil miscellaneous petition in C.M.P.No.1460 of 2026 in OSA.(CAD).No.121 of 2025 stands dismissed. No costs.
