Respondents This case is taken up for settlement before the National Lok Adalat. Both the parties are present. Mr.T.Ravichandran, learned counsel for appellant is present and Mr. Mukund R. Pandian, learned counsel for the respondents is present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT Challenging the award of a sum of Rs.3,24,388/- granted towards the injury suffered by one P.M.Arun, the Insurance Company has filed the instant Civil Miscellaneous Appeal.

2. Both the parties are present before us. After due deliberation and consultation, both the parties have agreed to settle the claim for a sum of Rs.3,71,437/- (Rupees Three lakh seventy one thousand four hundred and thirty seven only) as full quit. It is informed by the learned counsel appearing for the insurance company that the said amount has already been deposited before the Tribunal. Out of the amount deposited, the Insurance Company will be withdrawing a sum of Rs.50,000/- and the balance amount can be withdrawn by the claimant.

3. The Tribunal is directed to transfer the amount through RTGS/NEFT to the parties concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
