ORDER
(Order of the Court was made by S.M.SUBRAMANIAM, J.) The writ of prohibition has been instituted to prohibit the respondents from constructing the passengers shelter in the outer village, which is located at the back side entrance of the Government Primary School in Nallurpalayam Village, Vadambacheri Village Panchayat, Sulur Taluk, Coimbatore District and consequently, direct the respondents to construct the passenger shelter in nearby Pattatharasi Amman Temple, Flag Hoist Post, Nallurpalayam Village, Vathambacheri Village Panchayat, Sulur Taluk, Coimbatore District by considering the petitioners' representations dated 15.12.2025 & 17.12.2025.
2. The relief as sought for in the writ petition is misconceived. Constructing passenger bus shelter is the administrative decision to be taken by the competent authorities considering various factors. The High Court, in exercise of powers under judicial review, may not issue direction to the authorities to construct the bus shelter in a particular place, which may cause prejudice to any other party. These decisions are to be taken by the competent authorities by assessing all factors, which are all necessary for construction of passenger bus shelter. Thus, writ of prohibition would not lie. However, the objections, if any, submitted by the petitioners may be considered by the
competent authorities and an appropriate decision in the public interest needs to be taken for construction of passenger bus shelter for the benefit of the public at large.
