C.M.P.No. 19372 of 2022 in C.R.P. No. 2977 of 2016 T.V. THAMILSELVI, J.

This petition has been filed seeking to set aside the order dated 12.01.2017 dismissing the Civil Revision Petition for default.

2. Earlier, this court by an order dated 31.10.2022 condoned the delay of 158 days in filing the petition to restore the C.R.P. in C.M.P.No. 13507 of 2017 on hearing both sides.

3. Ms.P.Vijaya Devi, learned Government Advocate appearing for revision petitioner submitted that when the counsel for petitioner sought time for assistance of learned Addl. Advocate General, this Court dismissed the Civil Revision Petition. Unless this Civil Revision Petition is restored, the petitioner would be put to great loss and hardship. Hence, he has filed the above petition and prayed to restore the above C.R.P.

4. Mr.S.Ramachandran, learned counsel for respondent appeared and submitted that he has no objection for allowing this petition.

5. Considering the facts and circumstances, and being satisfied with the reasons assigned in the affidavit filed in support of the petition seeking to restore the Civil Revision Petition, this Court is inclined to allow this petition and to restore the C.R.P.

6. Post the matter on 22.11.2022.
