ORDER

The petitioner, who was arrested and remanded to judicial custody on 03.11.2025, for the alleged offence punishable under Section 105 of BNS, 2023 read with Section 24(4) of the National Medical Commission Act, 2019 in Crime No.312 of 2025 on the file of the respondent police, seeks bail. 1/4

2. The allegation against the petitioner is that, while he was working in a medical shop, he administered an injection to the deceased, who had come to the shop to purchase medicines, which resulted in complications and led to the death of the deceased within a few hours. Hence, a case was registered and the petitioner was arrested.

3. Learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and that he did not administer any injection to the deceased. He further submitted that the petitioner had only advised the deceased to approach a nearby hospital, however, the same has not been properly considered. Hence, he prays to grant bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner is in judicial custody since 03.11.2025 and the investigation is still pending. He further submitted that if the petitioner is released on bail, there is a likelihood of his indulging in similar activities. Hence, he opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the manner in which the occurrence allegedly took place, the allegation that the petitioner administered an injection to the deceased 2/4

resulting in his death, and the fact that the investigation is still pending, this Court is not inclined to grant bail to the petitioner.
