ORDER
The petitioners, who were arrested and remanded to judicial custody on 14.11.2025, for the alleged offence punishable under Sections 24(1) of COTPA and 123 of BNS, in Crime No.370 of 2025, on the file of the respondent police, seeks bail.
2. The allegation against this petitioners is that, these petitioners were found in possession of 373 kgs 405 grams of banned tobacco products illegally. Hence this case.
3. The learned counsel appearing for the petitioners submitted that the petitioners have been falsely implicated in this case and the petitioners are in judicial custody since 14.11.2025; and that the petitioners are ready to abide by any stringent conditions that may be imposed by this Court and sought for bail to the petitioners.
4. The learned Government Advocate (Crl. Side) appearing for the respondent reiterated the prosecution case and submitted that these petitioners are ranked as A1 and A2, the petitioners are having one previous case. Hence, he strongly opposed for grant of bail to the petitioners. 2/6
5. Heard both sides and perused the materials available on record including the First Information Report.
6. Considering the nature of offences, though the petitioners are having one previous case, in that case already bail was granted to him and considering the period of incarceration, this Court is inclined to grant bail to the petitioners with certain conditions.
[a] Accordingly, the petitioners are ordered to be released on bail on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate No.VII, Coimbatore, and on further conditions that:- [b] the petitioners shall report before the respondent police daily at 10.30 a.m. until further orders.
[c] the petitioners shall not commit any offence similar to the offence of which he is accused, or suspected, or of the commission of which he is suspected;
[d] the petitioners shall not abscond either during investigation or trial;

[e] the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence;
[f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
[g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
