ORDER

The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 4(1-A) of the TNP Act in Crime No. 172 of 2025, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was found in illegal possession of 230 litres of pondy arrack without any valid permission. Hence, the complaint.

3. The learned counsel for the petitioner submitted that it is a case of false acquisition and, since the petitioner has some previous cases, it has been foisted. He further submitted that though 70 previous cases were reported against the petitioner, only 13 cases are pending. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) would submit that the petitioner was found in illegal possession of 230 litres of pondy arrack without any proper license. He would also submit that there are 70 previous cases pending against the petitioner. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the fact that it is a prohibition offence involving possession of 230 litres of pondy arrack, and taking note of the fact that the petitioner is also having previous cases, this Court is not inclined to grant bail to

the petitioner. Accordingly, the Criminal Original Petition is dismissed. 05-01-2026 Mpa Index:Yes/No Speaking/Non-speaking order Internet:Yes To 1.The State Rep. by Inspector of Police, Nagoor Police Station, Nagapattinam District.
