ORDER

The petitioner, who was arrested and remanded to judicial custody on 20.10.2025, for the alleged offence punishable under Sections 191(2), 191(3), 126(2), 296(b), 109(1) of BNS, 2023 in Crime No.329 of 2025, on the file of the respondent police, seeks bail. 1/4

2. The allegation against the petitioner is that the petitioner herein is ranked as A2 in this case and he joined hands with the other accused and due to previous enmity, he severely attacked the defacto complainant by using knife and other deadly weapons causing both his forehands severed. Hence the complaint has been lodged.

3. Learned counsel appearing for the petitioner submitted that based on the confession statement recorded from the co-accused, the petitioner herein has been falsely implicated in this case. This petitioner has not participated in the occurrence and has also not injured the defacto complainant in this case. He further submitted that earlier the petitioner was detained under Act 14 of 1982 and subsequently, it has also been revoked. Hence, he prays for grant of bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that this petitioner has also attacked the injured with knife and caused severe injuries and he has also produced the photographs of the injured and list of previous cases which indicates that the petitioner is having four previous cases of heinous crimes. Hence, he opposes to grant bail to the petitioner. 2/4

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the submissions made by the learned counsel on both sides and taking note of the grievous injuries sustained by the injured which has been revealed in the photographs and the list of previous cases of the petitioner indicating that the petitioner is having four previous cases and all are heinous crimes, this court is not inclined to grant bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. 07.01.2026 gv Note:
