ORDER

The petitioner, who was arrested and remanded to judicial custody on 29.10.2025, for the alleged offence punishable under Section 5(1), 5(j)(ii) r/w. Section 6 of Protection of Children from Sexual Offences Act, 2012 in Crime

No.47 of 2025, on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner who is hailing from native place of the victim, used to visit her house. Taking advantage of her loneliness, he repeatedly committed aggravated penetrative sexual assault on the victim girl, which resulted in her pregnancy. Hence, the petitioner was arrested.

3. The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and has been in judicial custody since 29.10.2025. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for the grant of bail to the petitioner.

4. The learned Government Advocate (Criminal side) appearing for the respondent police reiterated the prosecution case and submitted that the victim girl categorically stated in her statement that the petitioner is the one who committed aggravated penetrative sexual assault, and the DNA test is also pending. Hence, he opposed the grant of bail to the petitioner.

5. I have gone through the statement recorded from the victim girl, and it reveals very disturbing facts, including the way in which she was subjected to

aggravated penetrative sexual assault. Further, the DNA report is awaited, and if the petitioner is released on bail, there is a likelihood that he will tamper with the witness. Hence, I am not inclined to grant bail to the petitioner.
