ORDER

The petitioner, who was arrested and remanded to judicial custody on 11.12.2025 for the offences punishable under Sections 194 of BNSS Act @ Section 108 of BNS Act, 2023, in Crime No.525 of 2025 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner and the deceased were alleged to have been in illegal contact and on the date of occurrence, the petitioner got enraged, quarrelled and scolded the deceased, which caused great insult and mental agony to the deceased; that thereby, she committed suicide by hanging. Hence, this case.

3.The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 11.12.2025; that the petitioner only made casual enquiry with the deceased regarding the relationship between them; that the petitioner had not abused or scolded the deceased or abetted her to commit suicide; and that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

4.The learned Government Advocate (Crl.Side) for the respondent police reported that the deceased and the petitioner were having illegal contact and on the date of occurrence, the petitioner threatened the deceased and abetted her to commit suicide. He further submitted that the FIR is registered only on 09.12.2025 and the investigation in this is pending. He also submitted that there is no previous case pending against the petitioner. Hence, he opposed for the grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record.

Considering the rival submissions on either side, considering the nature of offences charged against the petitioner, considering the relationship between the parties, that there is no previous case pending against the petitioner and also considering the period of incarceration of the petitioner, I am inclined to grant bail to the petitioner subject to the following conditions:

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties, for a like sum to the satisfaction of the learned Judicial Magistrate II, Hosur, and on further conditions that:- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity; [b] the petitioner shall report before the respondent police daily at 10.30 a.m., until further orders;

[c] the petitioner shall not abscond either during investigation or trial;

[d] the petitioner shall not tamper with the evidence or

witness either during investigation or trial; [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
