of the agricultural lands comprised in Survey Nos.46,47,48,49,50 and 55 measuring an extent of 9 Acres 90 Cents situated at Aandarmadam Village, Ponneri Taluk, Tiruvallur District which are the absolute properties of the petitioners and consequentially forbear the respondents from entertaining, registering or permitting any further third party transactions or such other alienation in respect of the said properties on the basis of documents has declared as sham, nominal and void. 2. The petitioners claim that one M.G.Ponnusamy had approached them for sale of the property. The petitioners had executed two Power of Attorneys on 31.01.2007. The said Power of Attorneys were also registered on the file of the Sub Registrar, Ponneri. To their shock and surprise, they got to know that the said Ponnusamy had attempted to fraudulently deprive them of the property. Hence, they executed revocation deeds on 20.03.2007 and also had the same registered before the same Sub Registrar. After the revocation of the Power of Attorneys, the said Ponnusamy had executed sale deeds in favour of several third parties. This constrained the writ petitioners to file a suit before the District Munsif Court at __________Page 2 of 5
Ponneri seeking declaration and consequential relief of injunction. This suit was taken on file as O.S.No.291 of 2009 by a judgment and decree dated 10.11.2025. The learned District Munsif was pleased to decree the suit as prayed for and also declared that the sale deeds impugned therein are null and void. The petitioners approached the Registrar for the purpose of registering the decree passed by the Civil Court. As no action was forthcoming, they are before this Court by way of Mandamus.
3. Mr.Bharanidharan, Special Government Pleader states that the Sub Registrar shall register the decree in terms of the Registration Act within a period of one week from the date on which the document is presented for registration.
4. His statement is recorded and the writ petition is disposed of with a direction to the respondents herein to register the decree in terms of the Registration Act within a period of one week from the date on which the document is presented for registration.
