PRAYER : Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of Mandamus, directing the 1st and 2nd respondents to take action against respondents 3 & 4 from interfering in the civil disputes pending with the petitioner and 5th & 6th respondent in S.No.540A situated at Erranahalli Village & Post, Palacode Taluk, Dharmapuri District and pass orders.

ORDER
This writ petition has been filed seeking a mandamus to the respondents 1 and 2 to take action against the respondents 3 & 4, not to interfere with the civil dispute pending between the petitioner and the respondents 5 and 6, with regard to the subject property.
2. According to the petitioner, his mother Eswari was in continuous possession of the subject property at Survey No.540A situated at Eranahalli Village, Palacode Taluk, Dharmapuri District. After her demise, the petitioner and his family members were in possession and enjoyment of the same. The private respondents 5 and 6 have attempted to interfere with the petitioner's 2/6
possession and enjoyment of the property. Therefore, the petitioner had filed a civil suit and the same is pending. In the said circumstances, with the aid of third and fourth respondents, the private respondents are attempting to grab the subject property. The petitioner was threatened by the respondents 3 and 4 to hand over the property to the private respondents, failing which a false case would be foisted against him. Therefore, the petitioner has submitted a representation dated 22.12.2025 and the same has not been considered by the official respondents till date. Hence, the petitioner is before this Court.

The learned Government Advocate appearing for respondents 1 to 4 would submit that this petitioner has earlier approached this Court in W.P.No.21926 of 2024 and this Court had directed the Tahsildar, Palacode Taluk, to consider the representation of the petitioner dated 01.07.2024 after affording opportunity to all the parties concerned, and to pass orders within a stipulated time. Pursuant to the directions of this Court in the said writ petition, the Tahsildar, Palacode Taluk, Dharmapuri District had conducted enquiry and rejected the claim of the petitioner, to measure the property, on account of non-production of sufficient documents by the petitioner.
4. Now, the petitioner has filed the present writ petition as if the 3/6
respondents 3 and 4 are interfering with the civil matter pending between the petitioner and the private respondents. This statement of the petitioner was objected to by the respondents 3 and 4.
5. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the official respondents and also perused the materials placed before this Court.
6. This Court had recorded the statement made by the learned Government Advocate on instructions, that the 3rd and 4th respondents are not interfering with the civil dispute pending between the petitioner and the private respondents.
7. Recording the same, the writ petition is disposed of, without even issuing notice to the private respondents. Insofar as the grant of interim injunction restraining the other respondents viz., 5 and 6 are concerned, the petitioner can approach the civil Court in the manner known to law. 4/6
