ORDER
This Court, under order dated 24.03.2025 passed in O.P.No.933 of 2019, dismissed the application filed by the petitioner under Section 34 of the Arbitration and Conciliation Act, 1996. This petitioner, who is having the benefit of the arbitral award, would rely upon an observation made by this Court in paragraph No.13 of the said order for the purpose of filing this contempt petition.
2. This Court, while dismissing the application under Section 34 of the Arbitration and Conciliation Act, 1996, directed the respondents in O.P.No.933 of 2019 to pay the amount payable to the petitioner as per the arbitral award within a period of six (6) weeks from the date of receipt of a copy of the said order.
3. According to the petitioner, despite lapse of six weeks from the date of receipt of a copy of the said order, the respondents have not paid the amount to the petitioner as per the arbitral award and hence, this contempt petition is maintainable.
4. The only recourse available to the petitioner in the event of nonpayment of amount as per the arbitral award is to file an execution petition to execute the said arbitral award. Therefore, this contempt petition is not maintainable and liberty is granted to the petitioner to execute the arbitral
award against the respondents, which was the subject matter of challenge in O.P.No.933 of 2019, which ultimately came to be dismissed by this Court on 24.03.2025.
