ORDER

The petitioner who was arrested and remanded to judicial custody on 15.05.2025, for the alleged offence punishable under Sections 296(b), 103 of BNS @ 296(b), 103(1), 249(a), 238(a) of BNS in Crime No.194 of 2025, on the file of the respondent police, seeks bail. 1/4

2. The allegation against the petitioner is that this petitioner ranked as A1 in this case and his wife has developed illicit intimacy with one Vijay. Hence, enraged over the same, when he attempted to attack his wife, his mother-in-law is supporting his wife, he attacked his mother-in-law with iron rod and caused severe injuries which resulted in instantaneous death to her. Hence complaint was lodged and the petitioner is in custody from 16.05.2025.

3. Learned counsel appearing for the petitioner submitted that the petitioner herein was arrested and earlier detained under Act 14, 1982 and subsequently the same is also quashed by the High court in the Writ Petition filed on behalf of the petitioner herein. He further submitted the petitioner is in custody for the past 6 months and prays for grant of bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner has not only committed the murder of his mother-in-law, after committing the murder of the mother-in-law, petitioner went to the house of said Vijay and committed the murder of the parents of Vijay. Hence, it is noted that the petitioner involved in two separate murder cases and if the petitioner is granted bail, there is a likelihood of danger to the witnesses and other persons. Hence, he opposes to grant bail to the petitioner. 2/4

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the submissions made by the learned counsel on both sides and taking note of that though in the first occurrence it is seen that due to his rage over the illicit relationship between his wife and Vijay, he committed murder, the further action of the petitioner reveals that he had not only went to the house of the Vijay but also committed murder of two more persons and if the petitioner is granted bail, he would hamper the trial process. Hence, this court is not inclined to grant bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. Gv 07.01.2026 Note:
