ORDER

The petitioner, who was arrested and remanded to judicial custody on 27.10.2025 for the alleged offence punishable under Sections 302, 201 of IPC, 1860 in Crime No.297 of 2024 on the file of the respondent police, seeks bail. 1/4

2. The allegation against the petitioner is that he is a relative of A1 in this case and since A1's wife had illicit relationship with the deceased, all the accused went to the house of Allavuddin, poured petrol on him, set him on fire and thereby murdered the deceased. Hence, a complaint was lodged and the petitioner was arrested.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case, since he is a family member of A1, and that there is no specific overt act attributed to him. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for respondent police reiterated the prosecution case and submitted that the investigation is still pending. Hence, he opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the submissions made by the learned counsel on either side, the fact that the petitioner is actively participated in the occurrence, that the offence involves setting the deceased on fire and committing murder, and that the investigation is still pending, this Court is not inclined to grant bail to the petitioner.
