ORDER

The petitioner, who was arrested and remanded to judicial custody on 21.05.2025, for the alleged offence punishable under Sections 296(b), 332(b), 103(1), of BNS (a) 296(b), 332(b), 103(1), 49 of BNS in Crime No.118 of 2025, on the file of the respondent police, seeks bail. 1/5

2. The allegation against the petitioner is that the petitioner ranked as A1 in this case and his wife has developed illicit intimacy with one Vijay. Hence, enraged over the same, the petitioner went to the house of the said Vijay and he attacked the parents of Vijay with iron rod and caused severe injuries to them which resulted in their instantaneous death. Hence complaint was lodged. The petitioner is in custody from 21.05.2025.

Learned counsel appearing for the petitioner submitted that the petitioner herein was arrested and earlier detained under Act 14, 1982 and subsequently the same is also quashed by the High Court in the Writ Petition filed on behalf of the petitioner herein. He further submitted the petitioner is in custody for the past 6 months and prays for grant of bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner has not only committed the murder of his mother-in-law, but also he committed the murder of the parents of Vijay (totally 3 persons killed). Hence, it is noted that the petitioner involved in two separate murder cases and if the petitioner is granted bail, there is a likelihood of danger to the witnesses and other persons. Hence, he opposes to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

Considering the submissions made by the learned counsel on both sides and though in the first occurrence it is seen that due to his rage over the illicit relationship between his wife and Vijay, he committed murder of his mother-in-law and the further action of the petitioner reveals that he not only went to the house of the Vijay but also committed murder of two more persons, hence if the petitioner is granted bail, he would hamper trial process. Hence, this court is not inclined to grant bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. 07.01.2026 gv Note:
