Ms.J.R.Archana, Government Advocate (Crl.Side) Order The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 303(2), 326(a) of BNS and Section 21(1) of Mines & Minerals (Development & Regulation ) Act, 1957 in Crime No.288 of 2025, on the file of the respondent Police, seek anticipatory bail.

2. The allegation against the petitioner is that the petitioner was found in illegal transportation of 1 unit of river sand. Hence, the complaint.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that, petitioner has no previous cases.
5. Earlier, this Court dismissed the anticipatory bail petition filed by the petitioner in Crl.OP.No.32360 of 2025 dated 26.11.2025 on the ground that the petitioner had illegally quarried huge quantity of river sand and caused damage to the ecology and water body. However, there is no change in circumstances to revisit the earlier order established before this Court. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
