ORDER
The petitioner, who was arrested and remanded to judicial custody on 19.11.2025 for the offence punishable under Sections 108 of BNS 2023, in Crime No.754 of 2025 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the deceased Malathi, who is the wife of the petitioner/A1, had developed an illegal intimacy with another man. Thereby, a matrimonial dispute arose between the petitioner and the deceased. When the same was questioned by the petitioner, the deceased, unable to bear the same, committed suicide by hanging. Hence, the case. 4.The learned counsel for the petitioner would submit that the petitioner was not present at the time of scene of occurrence and that the deceased had committed suicide herself without any reason. He would further submit that the petitioner has been falsely implicated in this case and that he has been in custody since 19.11.2025 and therefore, he prayed to grant bail to the petitioner. 5.The learned Government Advocate (Crl.
Side) for the respondent police reported that the petitioner had assaulted the deceased due to which the deceased got frustrated and committed suicide by hanging and the investigation in this case is pending. He further submitted that there is no previous cases pending against the petitioner. Hence, he opposed for the grant of bail to the petitioner.
5. Heard both sides and perused the materials available on record.
6.Considering the rival submissions on either side, considering the nature of offences charged against the petitioner, that there is no previous case pending against the petitioner and considering that the petitioner is having tender age children and also considering the period of incarceration of the petitioner, I am inclined to grant bail to the petitioner subject to the following conditions:

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties, for a like sum to the satisfaction of the learned Judicial Magistrate Court Arni, Thiruvannamalai District, and on further conditions that:- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity; [b] the petitioner shall report before the respondent police daily at 10.30 a.m., until further orders;
[c] the petitioner shall not abscond either during investigation or trial;
[d] the petitioner shall not tamper with the evidence or witness either during investigation or trial;
[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];
[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
