ORDER

This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 26.11.2025, seeking bail in Crime No.170 of 2025 registered for the offence under Sections 8(c) r/w Section 20(b) (ii)(B), of NDPS Act, 1985.

The allegation against the petitioner is that the petitioner was found in possession of 8 kgs of ganja. Hence, the case. 3.

Learned counsel appearing for the petitioner would submit that petitioner is innocent and has not committed any offence and falsely implicated in this case, based on the confession of the arrested accused. He would further submit that the petitioner is ready to produce solvent sureties and to abide by any conditions that may be imposed by this Court and also undertake to appear and to co-operate for the investigation, therefore, he prayed for the grant of bail to the petitioner.

Learned Government Advocate (Crl. Side) appearing for the respondent police opposed for granting of bail to the petitioner, stating that the co-accused and the petitioner were involved in illegal selling of 8 kilograms of ganja. He further submitted that the petitioner has 3 previous cases of similar nature.

Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent police and perused the materials available on record including the FIR.

Considering the submissions made by the learned Government Advocate (Crl.Side), and the contraband involved is in huge quantity and the gravity of the offence committed by the petitioner, and also she is having 3 previous cases of similar in nature, hence this Court is not inclined to grant bail to the petitioner.
