ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 123 of BNS in Crime No.322 of 2025 on the file of the respondent Police, seeks anticipatory bail. 2.The allegation against the petitioner is that on 19.10.2025, while the respondent police were patrolling, they received secret information about drug

sale. Upon reaching the spot, the respondent police apprehended Accused-1 with 10 Tapentadol Hydrochloride 100 mg tablets. On further investigation, it revealed that A-1 had bought the tablets from the petitioner/A3, for the purpose selling. Hence, the case.

3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that only based on the confession of A1, this petitioner has been implicated in this case and the other co-accused (A1 and A2) have already been granted bail and this petitioner who is arrayed as A3 is ready to comply with any stringent conditions that may be imposed by this Court, hence, he prayed for grant of anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl.side) for the respondent police reiterated the prosecution's case and on instructions submitted that the petitioner is a habitual offender having 8 previous cases pending against him, out of which, one case in similar in nature and vehemently opposed to grant anticipatory bail to the petitioner.

5. Heard both sides and perused the records including the FIR.

6. Considering the fact that the petitioner is a habitual offender who has 18 previous case pending against him and granting anticipatory bail may hamper the investigation in this case and further, the petitioner will indulge in similar activities. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. - 08-01-2026 jai To 1.The Inspector of Police B-5 Kitchipalayam Police Station.
