ORDER

The petitioner apprehends arrest for the alleged offence under Sections 21(d), 36(a &e) of V Act of Tamilnadu Forest Act 1881 and Sections 9, 39, 50 51(d) of the Wild Life (Protection) Act 1972 and Section 25(1) (a) of Arms Act in STOR.No.3 of 2025 on the file of the respondent police. seeks anticipatory bail.

2. The case of the prosecution is that this petitioner joining hands with other accused, cut down 10 sandal wood trees from the forest area of Thiruvannamalai District While A1 was transporting the logs, he was intercepted and arrested by the respondent , which revealed that the petitioner also participated in the occurrence and after seeing the respondent ran away from the place of an occurrence. Hence, the present case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is not having any previous case and the arrested co-accused was enlarged on bail and the contraband was also seized and prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that investigation in this case is pending and there is no previous case against the petitioner. Hence, she opposed the grant of anticipatory bail to the petitioner.

5. I have also gone through the bail order passed by the Sessions Court , while granting bail to A1. However, considering the overt act attributed and the gravity of the offence, if the petitioner is granted anticipatory bail , there is likelihood of indulging in similar offence. Hence, I am not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 05.01.2026 Vv To
