O R D E R

The petitioner, who was arrested and remanded to judicial custody on 01.12.2024 for the alleged offence under Sections 8(c) r/w 22(c), & 29(1) of NDPS Act 1985, in Crime No.449 of 2024 on the file of Respondent Police, registered on the file of the respondent police, seeks bail. 1/4

According to the case of the prosecution, the petitioner/accused, along with other accused persons, entered into a criminal conspiracy for the illicit transporation and sale of contraband, and in pursuance of the said conspiracy, they were found in possession of 59 grams of Methamphetamine intended for sale, which was seized by the respondent police. Hence, this case.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. He further submitted that the petitioner is not connected with the offence and that only 37 grams of Methamphetamine, which is an intermediate quantity, was recovered from the petitioner, and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for the grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that the investigation is still pending and that, if the petitioner is enlarged on bail, he may commit similar offences and tamper with witnesses. He further submitted that the contraband involved is of commercial quantity and that the rigours of Section 37 of the NDPS Act would apply. Hence, he opposed the grant of bail to the petitioner. 2/4

5. Considering the nature of the allegations levelled against the petitioner and the fact that the investigation is at a nascent stage, this Court is not inclined to grant bail to the petitioner.
